If you do not agree with them, you must not use the website. The website is operated from Switzerland as part of the Parkito network of parking directories.

Nature of the service

This website is an informational directory of parking facilities. We are not the operator of the listed facilities, we do not control them and we are not a party to any transaction between you and any parking operator. Listings, prices, opening hours, capacities and other details are compiled from public and third party sources and may be incomplete, outdated or inaccurate at any time.

No warranty

The website and all content are provided as is and as available, without any warranty of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, fitness for a particular purpose, availability or non infringement. Information on this website is not advice. Always verify essential details, in particular prices, opening hours and access conditions, directly with the parking operator before relying on them.

Limitation of liability

To the maximum extent permitted by applicable law, we exclude all liability for any indirect, incidental, special, consequential or punitive damages, and for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of, or inability to use, the website or its content, regardless of the legal theory. To the same maximum extent, our total aggregate liability for all claims relating to the website is limited to the amount you paid us for the use of the website in the twelve months preceding the claim, or, where nothing was paid, to one hundred Swiss francs. Nothing in these terms excludes liability that cannot be excluded by law, including liability for intent or gross negligence.

Accounts

You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activity under your account. We may suspend or terminate accounts that violate these terms, abuse the service or create risk for us, for other users or for third parties, without prior notice where the circumstances justify it.

Acceptable use

You agree not to use the website for any unlawful purpose, not to interfere with or disrupt its operation, not to attempt to gain unauthorised access to any system or data, not to circumvent any technical protection, rate limiting or access control measure, and not to impose an unreasonable load on our infrastructure. Any use of the website by automated means outside the permissions expressly granted below is prohibited.

Database protection, scraping and data reuse

The collection of listings on this website constitutes a protected database in which we hold database rights, including the sui generis database right under Directive 96/9/EC and corresponding national laws. Any extraction or re utilisation of the whole or a substantial part of the database, and any repeated and systematic extraction of insubstantial parts, is strictly prohibited without our prior written licence. This prohibition covers in particular scraping, crawling, harvesting, bulk downloading, mirroring, framing, mass querying, monitoring by automated means and the use of our content or database for training, fine tuning or grounding of artificial intelligence or machine learning models. The only exception is access by public search engine crawlers that identify themselves truthfully and comply with our robots.txt directives for the purpose of building a public search index. We reserve the right to enforce these rights through technical measures and through all available civil and criminal remedies, and to claim compensation for any unauthorised commercial exploitation of our database.

Intellectual property and trademarks

All content of this website, including its structure, texts, design, code and compilations, is protected by copyright, database rights and other intellectual property rights. The Parkito name and logo are protected trademarks. Nothing on this website grants you any licence to use our trademarks, and any use of them, including in domain names, advertising keywords or software, requires our prior written consent.

User content

Where the website allows you to submit content, you grant us a non exclusive, worldwide, royalty free licence to host, display and reproduce that content in connection with the service. You warrant that your content is lawful and does not infringe third party rights. We may remove any user content at our discretion.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses and reasonable costs, including legal fees, arising from your breach of these terms, your unlawful use of the website or your infringement of any third party right.

Changes and termination

We may modify, suspend or discontinue the website or any part of it at any time. We may amend these terms at any time by publishing the amended version on this page, and your continued use of the website after publication constitutes acceptance of the amended terms. Provisions which by their nature are intended to survive termination, including the sections on database protection, intellectual property, limitation of liability and governing law, survive any termination.

Protection against unlawful conduct

Any threat, intimidation, blackmail, extortion, defamation or other unlawful act directed against this website, its operator, its team or its representatives, whether made in person, in writing, by email, by telephone or through any online or social media channel, will be taken seriously and may be pursued before the competent Swiss courts in Geneva. If we are compelled to take legal action to protect ourselves against such threats or unlawful conduct, or if a claim brought against us is dismissed, the person responsible shall bear all resulting costs and expenses, including but not limited to court fees, attorney and legal representation fees and any other reasonable costs we incur, to the fullest extent permitted by Swiss law, under which the unsuccessful party generally bears the costs of the proceedings.

Governing law and jurisdiction

These terms and any dispute, claim or legal matter arising out of or in connection with the website are governed exclusively by Swiss law, excluding its conflict of law rules. The exclusive place of jurisdiction for any such dispute is Geneva, Switzerland. If you are a consumer habitually resident in the European Union, mandatory consumer protection provisions of your country of residence remain unaffected. If any provision of these terms is held invalid, the remaining provisions remain in full force.
